Retailer Competition Terms and Conditions

Promoter: Mondelez Europe Services GmbH – UK Branch whose address is at Cadbury House, Sanderson Road, Uxbridge, UB8 1DH.

1. Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of entry.

2. Eligibility: This Promotion is only open to retailers in the UK, aged 18 years and over, who display Maynards Bassetts confectionery bags (400g, 160g or 190g) for the “Go Wacky Sheep Racing, A Chance To Win Flights To New Zealand” promotion (“Promotional Bags”). You must be a registered member of www.deliciousdisplay.co.uk Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this promotion are ineligible to enter.

3. Internet access, contact details, ability to take and upload photographs and
www.deliciousdisplay.co.uk account are required.

4. Promotion Period:  starts at 00.01 GMT and end at 23.59 GMT, Promotion Period Opening 15. 5. 17 (“Opening Date”) and closing 31.7.17 (“Closing Date”)

5. To Enter: Store managers must upload a photograph of their Promotional Bags displays to www.deliciousdisplay.co.uk via their account and submit their details including their retail outlet number, name, address, email address and telephone number. We recommend that photographs of displays would show adherence to our merchandising best practice as advised on www.deliciousdisplay.co.uk and stocking of our Promotional Bags.

6. Maximum of one entry per store. If there are multiple entries from one store the first valid entry is the only accepted entry from that store.

7. Entries will be deemed invalid if they:
a. contain defamatory, malicious, indecent or other inappropriate content;
b. include trademarks, logos or copyrighted material not owned by you or used without the right holder’s prior written permission (including famous names, company names etc) (except where there is incidental inclusion of other brands on the display);
c. include images of anyone who is or appears to be under the age of 18;
d. include the names, likenesses, photographs, videos or similar of any individual without their express permission; and
e. represent a danger to health and safety.

8. The Prizes: 5 winners will each win 1x £100 Love2shop voucher to the verified retailer manager. The Expiry date will be printed on each voucher. Please allow 28 days for despatch. The Prizes will be subject to Love2Shop voucher terms and conditions as found on www.love2shop.co.uk.

9. Winner Selection: All valid entries received by the Promoter during the Promotion Period will be entered into the relevant prize draw to be conducted within 7 working days of the Closing Date by the Promoter’s agency.

10. Winner Verification: Following the winner selection, the winning stores and reserve winning stores will be visited by the Promoted to verify that their Promotional Bag display. This visit will be conducted in secret and will take place within a period of 21 days after the Closing Date (“Verification Period”). All Promotional Bags entered in the Promotion should stay up during the Promotion Period and Verification Period. . If the Promotional Bags displays are removed prior to the end of the Verification Period, it will be up to the discretion of the Promoter as to whether a Prize is awarded.

11. Winner Notification: The winners will be notified by phone and/or email within 28 days following Winner Verification and will be required to respond within 14 days of initial contact. Failure to respond within this timeframe allows the Promoter the right to award the prize to a reserve winner selected in the same manner. Only winners will be notified.

12. Please allow up to 28 days to receive the Prize from the date of winner acceptance.

13. The Prize is non-transferable, non-refundable, non-exchangeable and there is no cash alternative.

14. If for any reason the prize winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. However, the Promoter reserves the right to provide an alternative prize of equal or greater value in the event of unforeseen circumstances.

15. No correspondence will be entered into.

16. The winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in promotional material.


MISCELLANEOUS

17. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for this purpose and a prize may be withheld unless and until the Promoter is satisfied with the verification.

18. All entries must be made by the entrant themselves. Bulk votes or entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, bulk votes, votes by or via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to vote), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the draw in a way that is not consistent with the spirit of the promotion, that entrant’s entries will be disqualified and any prize award will be void.

19. By entering the promotion, entrants give their permission for their photos to be used by the Promoter without further compensation for up to 1 year for promotion purposes. Copyright will remain with the entrant. However, by entering this promotion, the entrant agrees to the Promoter publishing these entries on but not limited to their website, Facebook, Twitter and Instagram. They also agree to other possible promotional use in media of the promoters choosing without any payment but with appropriate credit given to the original entrant for up to 1 year.

20. The Promoter may refuse to award a prize, or seek its recovery, in the event of an entrant's fraud, dishonesty or non-entitlement under these Terms and Conditions.

21. The winners agree to comply with the reasonable requests of the Promoter and its agents and to be responsible to the Promoter for the acts and omissions of their guests. Prize winners and their guest must act within the framework of acceptable and proper behaviour during the course of the trip and comply with all rules and regulations laid down by those providing the elements of the prizes. If a winner or their guest is deemed not to comply with these conditions of entry the Promoter may in its sole discretion cancel, terminate, modify or suspend any or all element of the relevant prize.

22. No responsibility is accepted for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt. The Promoter and any affiliated companies are not responsible for any entry, generated by computer hardware or software, malfunction, error or failure.

25. The personal information entrants provide will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants. The Promoter is bound by the Data Protection Acts (1984 and 1998).

26. The Promoter cannot accept any responsibility for any damage, loss, injury suffered by any entrant entering the promotion or as a result of accepting or participating in any prize. Nothing shall exclude the Promoter’s liability for death or personal injury as a result of its negligence.

27. If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.

28. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

29. By entering this promotion all participants will be deemed to have accepted and be bound by these terms and conditions.

30. This promotion is governed by the English Law and participants submit to the exclusive jurisdiction of the English courts.

2. Mondelez International accepts no responsibility for late, incomplete, incorrectly submitted, corrupted or misdirected orders for Point of Sale.

3. It is your responsibility to implement the Point of sale provided in your retail area which shall include erecting and maintaining the Point of Sale.

4. Where the Point of Sale allows for products to be stored on or within the Point of Sale, you must not exceed the weight allowance specified by Mondelez International in respect of the Point of Sale.

5. Mondelez International may in its sole discretion cancel, terminate, modify or suspend any orders for Point of Sale.

6. Mondelez International will not supply Point of Sale to retailers on sites such as Schools or other education establishments.

7. Mondelez International, it’s affiliates or associated agencies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with the Point of Sale, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

8. These terms and conditions are governed by English law and subject to the exclusive jurisdiction of the English courts.

9. Retailers are responsible for disposal of the unit at the end of its life.

10. We aim to deliver all units within 4 weeks but this is subject to availability and third party delivery. Mondelez International takes no responsibility with regards to late delivery.

11. Orders restricted to one unit per store.

12. Orders may be delivered by Mondelēz International sales representative in some cases.

Flake POS Terms and Conditions

Trebor Get Minted

1. Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of entry.

2. Entry is open only to retailers within the UK (England, Scotland, Wales and Northern Ireland), aged 18 and over who display the Trebor Get Minted point of sale displays. Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this promotion are ineligible to enter.

3. The promotion distribution period begins at 00.01 on 13th March 2017 (‘Opening Date’) and closes at 23.59 on 17th June 2017 (the ‘Final Distribution Date’) (‘Promotion Distribution Period’).

4. HOW TO ENTER: A total of 102 winning pack of Trebor Extra Strong Peppermint or Spearmint (41.3g), Trebor Softmints Peppermint or Spearmint (44.9g), Trebor Mighties Mint or Berry Mint (12.6g) (“Trebor Products”) will be fairly and randomly distributed amongst stocks of regular Trebor Products during the Promotion Distribution Period under the supervision of PromoVeritas, the independent promotional verification service. If a winning Trebor Product has been distributed in your store you will automatically be eligible to win the prize.

5. HOW TO RECEIVE YOUR PRIZE: Each winning Trebor Product distributed is recorded. At the point in time that a consumer calls to claim their prize, PromoVeritas, the independent verification service will match up the records to establish which store the winning Trebor Product was distributed in. The retailer will then be contacted and made aware that a winning Trebor Product was seeded and claimed within their store.

6. THE PRIZES: The winning Trebor Products are worth as follows: 1 x £5000; 5 x £500; 5 x £250; 30 x £100, and 61 x £50.

7. Prizes will be paid in the form of Mondelez Stock vouchers (Independent stores) or ‘Love to Shop’ Vouchers (Facia stores) to the verified retailer manager. Please allow 28 days for despatch. Type of prize awarded is at discretion of promoter.

  10. Winner Selection: All valid entries received by the Promoter during the Promotion Period will be entered into the relevant prize draw to be conducted within 3 working days of each closing date by an independent person.
  11. Winner Notification: The winners will be notified by phone and/or email within 28 days following Winner Selection and will be required to respond within 14 days of initial contact. Failure to respond within this timeframe allows the Promoter the right to award the prize to a reserve winner selected in the same manner.
  12. Prize Fulfilment: Please allow up to 28 days to receive the Prize from the date of winner acceptance.
  13. The Prize is non-transferable, non-refundable and there is no cash alternative.
  14. If for any reason the prize winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. However, the Promoter reserves the right to provide an alternative prize of equal or greater value in the event of unforeseen circumstances.

  17. MISCELLANEOUS

  18. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for this purpose and a prize may be withheld unless and until the Promoter is satisfied with the verification.
  19. All entries must be made by the entrant themselves. Bulk votes or entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, bulk votes, votes by or via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to vote), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the draw in a way that is not consistent with the spirit of the Promotion, that entrant’s entries will be disqualified and any prize award will be void.
  20. By entering the Promotion, entrants give their permission for their photos to be used by the Promoter without further compensation for up to one year for promotion purposes. Copyright will remain with the entrant. However, by entering this promotion, the entrant agrees to the Promoter publishing these entries on but not limited to their website, Facebook, Twitter and Instagram. They also agree to other possible promotional use in media of the promoters choosing without any payment but with appropriate credit given to the original entrant for up to one year.
  21. The Promoter may refuse to award a prize, or seek its recovery, in the event of an entrant's fraud, dishonesty or non-entitlement under these Terms and Conditions.
  22. No responsibility is accepted for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt. The Promoter and any affiliated companies are not responsible for any entry, generated by computer hardware or software, malfunction, error or failure.

  24. The personal information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the Data Protection Acts (1984 and 1998).
  25. The Promoter cannot accept any responsibility for any damage, loss, injury suffered by any entrant entering the promotion or as a result of accepting or participating in any prize. Nothing shall exclude the Promoter’s liability for death or personal injury as a result of its negligence.
  26. If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.
  27. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

    Full Terms and Conditions

    1. Entry is open only to retailers within the UK, aged 16 and over who display the White chocolate Cadbury Creme Egg point of sale displays within their retail outlet (only independent retailers). Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this Promotion are ineligible to enter.
    2. The Promotion distribution period begins at 00.01 on 1st January 2018 (‘Opening Date’) and closes at 23.59 on 1st April 2018 (the ‘Final Distribution Date’). All claims must be made by 5pm on 1st May 2018 (the ‘Claim by Date’).
    3. Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of entry.
    4. HOW TO ENTER: A total of 91 White chocolate Cadbury Creme Eggs will be fairly and randomly distributed amongst stocks of regular Cadbury Creme eggs in independent retail stores that display White chocolate Cadbury Crème Egg point of sale displays under the supervision of PromoVeritas, the independent promotional verification service. If a White chocolate Cadbury Creme Egg has been distributed in your store, you will automatically be eligible to win a prize once the winner of the White chocolate Cadbury Crème Egg registers their Egg with the Promoter.
    5. HOW TO RECEIVE YOUR PRIZE: Each White chocolate Cadbury Creme Egg distributed is recorded. At the point in time that a consumer calls to claim their prize, PromoVeritas, will match up the records to establish which retail store the White chocolate Cadbury Creme Egg was distributed in. Following a valid consumer claim, the retailer will then be contacted within 28 days and made aware that a White chocolate Cadbury Creme Egg was distributed and claimed within their store.
    6. RETAILER REQUIREMENTS: In order for a prize to be awarded to a winning retailer, the retailer must confirm acceptance of the Prize. Retailers will initially be contacted via the telephone number held on record by the Promoter or via the telephone number publicly available, only store managers will be communicated with. Two attempts will be made via telephone call and if a retailer does not claim the Prize via this process, a letter will be sent to the retailer in the post and requesting them to contact the Promoter within 14 days, from the date of the letter, should they wish to claim the Prize. Failure to accept the prize within this time period will result in the Prize being forfeited.
    7. THE PRIZES: There are 91 Prizes available to be won; a maximum of 13 White chocolate Cadbury Creme eggs are worth £1000 each and the remaining 78 are worth £100.
    8. UNCLAIMED PRIZES: If at the end of the promotion, any consumer White chocolate Cadbury Creme Eggs are unclaimed, PromoVeritas will establish which retail stores have not had a claim and contact those within 28 days of the Claim by Date to notify them of their win. Any prizes awarded in this manner will be to the value of £100.
    9. Prizes will be paid in the form of Cadbury Stock vouchers (Independent stores) or ‘Love to Shop’ vouchers (facia stores) to the verified retailer manager. Please allow 28 days for despatch from date of Prize acceptance. Vouchers must be used before expiry date printed on voucher. Type of prize awarded is at discretion of Promoter. Prizes for participating food service outlets (Elior, Aramark, Compass, NHS, Sodexo, Mitie) will be paid in the form of AA rosette restaurant vouchers to the value of £500 to the verified manager. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
    12. The prizes are not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation.
